Employment Litigation: Younesi & Yoss represents both employees and employers in employment cases. Litigation Approach: Younesi & Yoss involves its clients in the process of developing a strategy for any particular case. At the outset, we discuss the facts of the case at length with the client to discern the relative strengths and weaknesses, as well as the potential defenses and areas for discovery. We then elicit from the client information concerning the client’s level of litigation and risk aversion and the client’s financial expectations. From the outset, we speak frankly with the client about the costs of the litigation, the risks involved and the potential for settlement. Younesi & Yoss represents clients of high integrity. Often, cases are filed by plaintiffs for illegitimate reasons, usually to procure a quick settlement with no veracity to the claims. In these circumstances, Younesi & Yoss takes an aggressive litigation posture and exposes the specious nature of these claims. Younesi & Yoss has been successful in quickly defeating such claims. We typically design a discovery plan in coordination with the client, keeping in mind budgetary concerns. In litigation defense cases, we posture the case to move for summary judgment as early as possible where such action is warranted. In those cases where there appears to be economic or strategic prudence served by settling, we recommend retaining a professional mediator to conduct a settlement conference. Overall, we balance the costs of litigation with the potential exposure and risks and continue to re-evaluate the strategy of each case as it develops.
